By listing one's property on FSBODayton.net, the Seller agrees to the following terms and conditions:

1. FSBODayton.net represents neither the buyer nor the seller.  FSBODayton.net simply provides an advertising/promotional forum for its subscribers.  The duration of this service is 90 days.  Service duration may be extended for $10 per month from the expiration of the initital 90-day period mentioned above until the closing date for the sale of the property, or until the listing Seller decides to take the property off the market or list the property with a real estate agent or broker.
2. The original service fee is non-refundable and non-transferable.
3. The home Seller is exclusively responsible for the accuracy of the listing.  Furthermore, the seller agrees to indemnify, defend and hold harmless FSBODayton.net for any actual or alleged damages resulting from claims related to the accuracy of the listing or information provided therein.
4. This service is for one property only and may not be transferred to another property without the written approval of FSBODayton.net.  As part of this service the Seller will receive a sign to display in front of the home for sale.  The Seller agrees that the Seller is renting this sign and that FSBODayton.net owns the sign.  A One Hundred Dollar ($100) fee will be charged if the sign is not returned to FSBODayton.net in an acceptable condition and within three days after the home is taken off the market.  The Seller will contact cancel@ FSBODayton.net to arrange for someone to pick up the sign.
5. The Seller is responsible for any damage to the sign beyond normal wear and tear. Nothing may be attached to the FSBODayton.net supplied yard sign, other than placards supplied by FSBODayton.net .
6. The sign described in the preceding paragraphs will be delivered only to properties in the eight county FSBODayton.net area.
7. The Seller agrees to locate and verify a safe location for the sign and agrees that FSBODayton.net is not responsible for any damage to underground utilities, sprinkler pipes or any other objects that could be damaged by the installation of the sign.  To check for buried electrical, plumbing or gas lines, call Ohio Utilities Protection Services (OUPS) at 800 362-2764 or visit  www.oups.org.
8. The Seller agrees not to list property on FSBODayton.net while the same property is listed with a real estate agency or broker.  The Seller agrees that listing a property on FSBODayton.net is an exclusive arrangement and further agrees that the property shall not be listed on any other For Sale By Owner website or service while the property is listed with FSBODayton.net.
9. The Seller agrees that any buyer's agent or broker shall not be allowed to place a yard sign on or near the property at any time while the property is listed with FSBODayton.net.
10. The Seller agrees to place a "Sale Pending" placard (provided to the Seller by FSBODayton.net), on the FSBODayton.net yard sign upon execution of a purchase agreement, allowing the "Sale Pending" placard to remain on the yard sign either until the closing or until such time that a sale is no longer pending.
